These Terms of Service ("Terms") govern your use of One Southern Santa's personalized Christmas message service. By using our service, you agree to these terms. Please read them carefully, sugar!
Important: Our service operates on a "Santa via Mommy" model - all personalized content is delivered exclusively to parents/guardians, never directly to children. You, as the parent, maintain complete control over when and how to share our content with your child.
1. Service Description
One Southern Santa provides personalized Christmas-themed written messages and related content created for children but delivered exclusively to parents/guardians via email. Our service includes:
- Custom-written messages featuring expressions and charm
- Personalized content based on child's name, age, and interests you provide
- Holiday-themed photos and workshop updates
- Special recognition for military families
- Email delivery to parents with complete control over sharing
2. Parent/Guardian Responsibility
By using our service, you acknowledge and agree that:
- You are the parent, legal guardian, or authorized caregiver of the child
- You have full authority to make decisions about content sharing with the child
- You will review all content before sharing it with your child
- You assume full responsibility for determining age-appropriateness
- You control the timing, context, and manner of content delivery to the child
- The child's reaction and emotional response is your responsibility to manage
3. Content and Entertainment Purpose
All content provided by One Southern Santa is for entertainment purposes only. We create fictional, Christmas-themed content designed to spark joy and wonder. You understand that:
- Content is creative fiction and entertainment, not factual information
- We are not responsible for maintaining or disrupting belief in Santa Claus
- Parents decide how to present fictional elements to their children
- Individual children may react differently to fantasy content
4. Information Collection and Privacy
We collect only essential information needed to personalize and deliver your content:
- Parent/guardian name and email address (retained for service delivery and future communications)
- Child's first name, age, and interests (used temporarily for content creation only)
- Military status (if applicable for free service)
- Special requests or circumstances you choose to share
Important Data Handling: We do NOT collect information directly from children under 13. Child-specific information (name, age, interests) is used only for immediate content creation and is deleted within 30 days of service delivery. Only parent/guardian contact information is retained for future service updates and marketing communications. You may opt out of future communications at any time.
5. Payment and Refunds
Payment is due at the time of service selection. Military families receive complimentary service upon verification. Refunds may be provided at our discretion for service delivery failures, but not for subjective satisfaction with content creativity or child reactions.
6. Limitation of Liability
One Southern Santa provides content to adults for their personal use. Our liability is limited to the amount you paid for services. We are not responsible for:
- Your child's emotional or behavioral reactions to content
- Timing or context of how you share content
- Family disputes or disappointment related to content
- Technical delivery issues beyond our reasonable control
- Loss of belief in Santa Claus or holiday traditions
7. Intellectual Property
All content created by One Southern Santa remains our intellectual property. You receive a personal, non-transferable license to use content with your immediate family only. You may not redistribute, sell, or commercially use our content.
8. Service Availability
Our service operates seasonally (typically November-January). We reserve the right to limit orders during peak demand or refuse service for any reason. Service availability depends on order volume and timing.
9. Modifications
We may update these Terms as needed. Continued use of our service constitutes acceptance of updated terms. Material changes will be communicated via email when possible.
